QProctor Terms of Use

1. INTRODUCTION AND ACCEPTANCE
These Terms of Use apply to the QProctor platform and all services under qproctor.com operated by KC TEK Software Technologies ("KC TEK", "Company"). KC TEK is a local and national technology company founded in 2011, specialized in AI technologies, public software development, educational technologies and certification software. By registering, logging in, or using any exam service, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree, do not use the Service.
2. DEFINITIONS
a) QProctor: AI-powered online exam proctoring service. b) Institution: University, company or educational institution creating the exam. c) Candidate / User: Person taking the exam. d) Proctor: Authorized person monitoring the exam live or via recording.
3. SCOPE OF SERVICE
QProctor provides exam security through camera, microphone, screen recording, browser lockdown, facial recognition, gaze tracking, second person detection and anomaly detection. Reference projects include: AFAD Education Portal, Diyanet Academy, Acunmedya Academy, Nuclear Regulatory Authority, Anadolu University Remote Exam System and Turk Telekom Artificial Intelligence / Cyber Security / Cloud Computing Exams. The Company does not guarantee uninterrupted or error-free service.
4. ACCOUNT AND SECURITY
4.1. You warrant that information provided during registration is accurate and up-to-date. 4.2. You are responsible for confidentiality of your account credentials and all activities under your account. 4.3. If you are under 18, you may use the Service only with parental consent. 4.4. Creating multiple accounts or opening an account on behalf of another person is prohibited.
5. USER OBLIGATIONS
You agree to: a) Allow camera, microphone and screen sharing during the exam. b) Be alone in the exam environment. c) Complete identity verification and 360-degree room scan. d) Meet technical requirements: working camera, microphone, stable internet (min 5 Mbps), updated Chrome/Edge browser.
6. PROCTORING AND CHEATING DETECTION
6.1. All exam sessions are recorded and analyzed by AI. 6.2. The following are flagged as suspicious: continuously looking away from the screen, detection of another person or voice, use of cheat sheets, use of a second screen/device, disappearance of face and impersonation. 6.3. In case of suspicion, your exam may be invalidated by the Institution. The decision authority is the Institution, not QProctor. 6.4. Appeals must be submitted to the relevant Institution within 7 days after the exam.
7. PROHIBITED USES
a) Reverse engineering or copying source code. b) Using bots, scrapers or VPN to manipulate the system. c) Recording, screenshotting or sharing exam questions. d) Uploading malicious software or viruses. e) Taking an exam on behalf of someone else or attempting to do so.
8. PRICING
8.1. The Service is paid for by Institutions. Pricing is based on packages. 8.2. Whether additional fees are charged to Candidates depends on Institution policy. 8.3. Fees are non-refundable unless the service is defective.
9. INTELLECTUAL PROPERTY RIGHTS
All software, design, logo, algorithms and content of the platform belong to KC TEK and are protected under Turkish Law No. 5846 on Intellectual and Artistic Works. Exam questions belong to the respective Institution.
10. PERSONAL DATA AND PRIVACY
10.1. For exam security, QProctor processes: full name, email, video and audio recordings, screen recordings, IP address, device information and biometric face data. 10.2. Data is processed in accordance with Turkish KVKK Law No. 6698, aligned with GDPR, and our Privacy Notice. Data is shared with the Institution for exam reporting. 10.3. Records are stored for 2 years from the exam date and then anonymized or deleted. Stored in ISO 27001-certified infrastructure with end-to-end encryption. 10.4. You cannot take the exam without granting camera and microphone permission. Granting this permission is considered explicit consent under KVKK.
11. LIMITATION OF LIABILITY
QProctor is only an exam proctoring tool. It is not responsible for exam content, evaluation or pass/fail decisions. To the extent permitted by law, the Company's liability is limited to the fee paid for the relevant exam in the last 1 month.
12. MODIFICATION AND TERMINATION
The Company may suspend, discontinue or modify the Service and these Terms at any time. Changes become effective upon publication on the website. Accounts violating rules may be suspended or permanently closed without prior notice.
13. GOVERNING LAW AND JURISDICTION
Turkish Law shall apply to disputes arising from this agreement. Istanbul (Caglayan) Courts and Enforcement Offices shall have jurisdiction.
